Hopefully not 2 years, but yes, obtaining the B1 if I have to file the sec 14 app would be realistic. I am wondering if my stag5 is rejected if I just need to follow up with a new application or if I need to resend all new documents. Do you know if when sending in if they can refer to the documents from my other application since they are mostly the same? It would be a hassle to have to obtain those documents again and reapostille and translate!

We shall see the outcome - and since 1 year has passed, I hope to have some resolution soon. Polaron did have me sign a form that gave them permission to act on my behalf. It was the BVA's Vollmacht form. Since it is a BVA form, I didn't ask if they used (or needed to) for document retrieval.

I have German family that I am in touch so I can say that as well as have travelled there, but no other ties. And zero German language skills (thus applying under stag 5). But I intend to get my language skills up a good level, which clearly might be needed if 14 is how I have to go. And yes, it is up to the discretion of the worker who gets the file, so I hope you have good luck! It may be the road I have to go down at some point...

when you submitted the 14 app, were you also required to have "close ties" to Germany or a German language requirement or is the whole "angle" having to do with ancestry only? I used Polaron and not a lawyer. I decided to go with them because they gathered German docs, handled the apostille and translation process, completed the application and provide follow up w BVA and also further support if rejected to rework and additional application. So in my opinion it was worth the $ to make sure I had everything in order.... Best of luck with your process and I will try to keep folks on the site informed as things arise....

My mother was born in 1941, so quite a bit before the 1949 deadline... I asked Polaron several times (out of my paranoia of being rejected) if the date of her birth was too far off, which is why the looped back with BVA several times to discuss. They might have spoken to someone who shown more flexibility, but maybe things are changing with Ukrainian refugees or general crack down on keeping to the years. I guess I need to continue to wait. From what I read and hear from Polaron, the BVA does thoroughly review the applications and generally do try to assist in getting you approved by suggesting an alternative route if you currently wouldn't get approved. Possibly your attorney can call the BVA to discuss - maybe the BVA would shed insight on your likelihood of approval under 5 vs 14 before hand. I would imagine their giving this guidance would be an incentive to ensure one one application from you instead of 2 in total... It would be great to hear what you decide and how/why you/your attorney made that decision.

Hi there. I hired an agency to help me prepare my application. I have the same situation as you and the agency contacted the BVA on 3 different occasions to ask them if falling outside the date range would be an automatic rejection for my Stag 5 application (they provided all my details and dates to the people they spoke at the BVA). All 3 times the BVA responded with the same answer: we look at each application individually and review them in the spirit of the law (gender discrimination because a German woman married a non-German man) and the BVA said that they encouraged me to apply. The agency I hired (Polaron) said that they don't take on new clients unless they are confident of approval, so they did this additional screening with the BVA before taking me on. My paperwork was filed on 25 Jan 22. So far I haven't heard a decision, but Polaron said they are starting to hear back from the BVA on other clients who sent in applications around the same time as mine. I hope to hear from them soon. Polaron said they have never received a rejection from the BVA, but in some circumstances the BVA would either ask for more documents or ask for an application under a different law (which is clearly what you are asking this forum - 5 or 14?)... My agency felt that 5 would be most successful for me after consultation with the BVA. Best of luck to you!
